Mayor Louis Sanders called the May 23, 2024, Village of Attica Council regular meeting to order at 7:30 PM.
Roll Call: Ed Beamer, Owen Best, Keith Hopple, Kirk Stanfield,
Others Present: Superintendent Tom Scott, Administrator Bryan Shock, and Joyce Keaton
Absent: Nicole Lenhart
Approval of Warrants: Motion by Councilman Best, seconded by Councilman Beamer to approve the warrants for payment. Vote: 4-0. Motion carried.
Approval of Minutes: Motion by Councilman Beamer to approve the 4/25 & 5/9 minutes, seconded by Councilman Best. Vote: 5-0. Motion carried.
Written & Oral Communication: Joyce Keaton was present to discuss water.
Public Safety: Councilman Best asked Admin Shock if there were any updates from the Sheriff’s Office. Admin Shock indicated there was not anything new.
Streets & Properties: Councilman Beamer shared the complex area off Cook Drive was annexed into the village in the 90’s. Joyce Keaton spoke up indicating she has issues receiving her mail using her Mill St. address. She believed the street name had been changed to Venice Hill Ct. Mayor Sanders shared the Village never changed the name of the street from Mill Street to Venice Hills Court. He shared someone who lived on the street reached out to a utility provider at some point and changed their address to Venice Hills Court. Mayor Sanders indicated he believed the phone company was contacted and that is how address changed. Councilman Beamer asked the Fiscal Officer to reach back out to the County and ensure their records indicate Mill Street. Councilman Best reported he would reach out to Google.
Admin Shock indicated he hired Jason Darling to expose the tile on Buckeye Drive to allow a camera to run the tile. He then had Darr’s come out to camera the tile. He said it looks like Ms. William’s house was built on top of the tile and it may be collapsed. He is going to have Jason Darling come back out and excavate further and then have Darr’s come run the camera a little further to ensure that is the issue. Admin Shock indicated if the tile is broken under her house that would be her responsibility.
Councilman Beamer is going to reach back out to Bucyrus Road Material again to discuss paving.
Councilman Best has a meeting scheduled with Charlene Watkins on Tuesday to discuss a tax abatement.
Admin Shock indicated he remedied the tax issue on N. & S. Woodwind St. He said we will receive a packet in June.
Parks: Supt. Scott indicated he believed they discovered the water leak at the park around the pool. The bathrooms are in operation now. Mayor Sanders asked if the porta pots were still out there. Supt. Scott indicated they were still out there. Supt. Scott reported the porta pots could be pulled, but Councilman Best and Fiscal Officer Hatfield asked about unlocking after hours and weekends, and cleaning. Council agreed to leave the porta pots but still use the restrooms.

Cemetery: Councilman Hopple shared the cemetery will meet on June 10th.
Personnel: Fiscal Hatfield asked Council to discuss vacation time for Tom. Councilman Best asked Supt. Tom if they could discuss vacation time after the meeting. Supt. Tom didn’t object.
Councilman Best also reported he would like to enter executive session at some point to discuss hiring a part time mower.
Councilman Best moved to hire Glen Wise as a part time mower at $12-15 an hour, Councilman Beamer seconded the motion. Vote: 3-1 with Councilman Stanfield voting no. Councilman Stanfield thought Admin Shock could help mow, like Greg Martin did previously.
Zoning Commission: Admin Shock shared he tried to get ahold of the LLC for Mr. Legron. Councilman Beamer shared his thoughts on the matter, he indicated if Mr. Legron would get a petition indicating the rest of the neighbors were not opposed to the project.
Finance and rule: Cash balance: $1,414,877.22 All funds include CDs and reserved or restricted funds, and debt reserve funds. FO Hatfield shared the March Bank reconciliation was presented for review. Fiscal Officer Hatfield reminded Council that the parks tax levy is expiring at the end of the year. This resolution requests tax valuation from the county auditor to move forward with putting the levy on the November ballot.
1st read RES 2024-12 A Resolution of Necessity on a Tax Levy in Excess of the Ten Mill Limitation for providing park operation.
Fiscal Officer Hatfield also shared she had RES 2024-13 Amending Appropriations to encumber the funds ($15,000) from OWDA for Regionalization Planning.
Councilman Beamer moved to suspend the three-read rule on Resolution 2024-13, Councilman Best seconded the motion. Vote: 4-0. Motion Carried.
Councilman Beamer moved to declare an emergency on Resolution 2024-13, Councilman Best seconded the motion. Vote: 4-0. Motion carried.
Councilman Beamer moved to adopt Resolution 2024-13, Councilman Best seconded the motion. Vote: 4-0. Motion carried.
Water & Sewer:
Jaime was in attendance. He shared that he and Will had been working on treating the reservoirs. Jaime shared he drafted a proposal to hydro excavate and handle the lead line inventory. He is hesitant to turn in a report to the EPA that he needs to sign off on with information that could potentially be incorrect. He would prefer to handle the inventory himself and hire someone to come survey homeowners in the evening. No decision was made. Councilman Best shared he spoke to the EPA. They reported since the village is actively working on regionalizing, they are not going to require us to do a general plan. Councilman Best shared that he had the draft agreement from Matt Dooley. He wanted to allow council to review it prior to sending the agreement to Willard for review. Councilman Stanfield requested a copy.

Executive Session: Councilman Best moved to enter executive session to discuss personnel at 8:55 pm., Councilman Beamer seconded the motion. Vote: 5-0. Motion carried.
Councilman Best moved to exit executive session at 9:05 pm, Councilman Beamer seconded the motion. Vote: 4-0. Motion carried.
